1. Acceptance of These Terms
This website is operated by Clarksville Guns & Archery, located at 1690 Golf Club Ln, Clarksville, TN 37043. By browsing the site, creating an account, or placing an order, you agree to these Terms of Service and to our Privacy Policy. If you do not agree, please do not use the site or place an order.
2. Eligibility to Purchase
To buy from us you must be of legal age and legally permitted to purchase and possess the items you order. Under federal law, you generally must be at least 18 to purchase long guns and ammunition for long guns, and at least 21 to purchase handguns and handgun ammunition. You must not be a "prohibited person" under federal or state law. All firearm purchasers must pass the required background check before any firearm is transferred. We reserve the right to verify eligibility and to refuse or cancel any order.
3. Products, Pricing, and Availability
- Prices, descriptions, images, and availability are subject to change without notice, and some items are special-order or shipped from a distributor warehouse.
- We work to keep listings accurate, but errors in price, description, or availability can occur. If we discover an error on an item you ordered, we may correct it, cancel the order, or contact you before proceeding, and we will refund any amount charged for a cancelled item.
- We may limit quantities, decline, or cancel orders at our discretion, including suspected fraud, resale, or compliance concerns.
- Listing an item does not guarantee it is available, in stock, or legal to ship to your location.
4. Firearm Orders and FFL Transfers
Federal law requires that firearms be transferred to you in person through a Federal Firearms Licensee (FFL). The following applies to every firearm purchase:
- Firearms are shipped only to a licensed FFL dealer — never to a residence. You are responsible for selecting an FFL that agrees to receive your transfer, and for any transfer fee that dealer charges, which is paid directly to that dealer.
- You must complete ATF Form 4473 and pass a background check (NICS) at the receiving dealer before the firearm can be released to you.
- If you fail the background check, are otherwise prohibited, or the transfer cannot be completed, the firearm will be returned to us. In that case we will refund the purchase price of the firearm, less any shipping and reasonable return and restocking costs permitted by law.
- You are responsible for confirming that the specific firearm you order is legal to own and transfer in your state and locality.
- For in-store and local pickup, the transfer is completed at our store, subject to the same background-check and documentation requirements.
5. NFA / Class III Items and Suppressors
NFA items such as suppressors are not sold through standard online checkout. These purchases are handled in person or through our suppressor-purchase partner, and are subject to ATF approval, additional paperwork, applicable tax stamps, and the wait times required by law. Contact the store or visit us to start an NFA purchase.
6. Ammunition and State Restrictions
Some products — including ammunition and certain magazines or firearms — are restricted or prohibited in some states and localities. Ammunition and other pickup-only items may not be available to ship to every location. Your cart will show applicable restrictions at checkout before you pay. You are responsible for knowing and following the laws that apply where you live. We will not ship items where doing so would violate the law, and we may cancel and refund such orders.
7. Orders, Payment, and Taxes
- Online orders are paid by card at checkout. Submitting an order is an offer to buy; your order is accepted when we begin processing it. A card authorization is not final acceptance.
- Tennessee sales tax of 9.5% applies to taxable items. A card surcharge may be added to online card payments, and the amount is shown before you pay.
- We use address verification and other fraud-prevention tools and may hold, verify, or cancel orders that fail these checks.
8. Shipping and Risk of Loss
Shipping rates, zones, and timeframes are described on our Shipping Policy page. Risk of loss passes to you when the carrier takes possession of the shipment, or, for firearms, upon delivery to your chosen FFL. Estimated delivery times are not guaranteed.
9. Returns and Refunds
Once a firearm has been transferred to you, it cannot be returned. If a firearm is defective, it is handled through the manufacturer's warranty. Cancelled or undeliverable firearm orders are refunded as described in Section 4. For non-firearm items, returns may be accepted within the period and conditions described in our store return policy — items generally must be new, unused, and in original packaging, and certain items may be non-returnable or subject to a restocking fee. To start a return or ask about eligibility, contact us before sending anything back.
10. Layaway
Layaway purchases are governed by separate layaway terms, including deposit, fee, term length, and eligibility rules. See our Layaway page for the current terms, which apply in addition to these Terms of Service.
11. Range, Classes, and Services
Use of our indoor range, enrollment in classes, and gunsmithing or other services are subject to additional rules, safety requirements, and waivers presented at the time of booking or check-in. Range and class fees may be non-refundable. All participants must follow staff instructions and posted safety rules.
12. Your Account
If you create an account, you are responsible for keeping your login credentials confidential and for activity that occurs under your account. Let us know promptly if you believe your account has been used without your permission.
13. Acceptable Use
You agree not to use the site unlawfully, to interfere with its operation or security, to attempt unauthorized access, to scrape or harvest data, or to use it to facilitate any purchase that would violate the law. We may suspend or terminate access for misuse.
14. Intellectual Property
The content on this site — including text, logos, graphics, and layout — belongs to Clarksville Guns & Archery or its licensors and is protected by law. Product names, images, and brands are the property of their respective owners. You may not copy or reuse our content without permission.
15. Disclaimers
The website and its content are provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent allowed by law. We do not warrant that the site will be uninterrupted, error-free, or secure. Nothing here is legal advice about your eligibility to purchase or possess any item; that is your responsibility to determine.
16. Limitation of Liability
To the fullest extent permitted by law, Clarksville Guns & Archery is not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the site or the products you buy. Our total liability for any claim relating to an order will not exceed the amount you paid for the item giving rise to the claim. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.
17. Indemnification
You agree to indemnify and hold harmless Clarksville Guns & Archery and its owners and employees from claims, losses, and expenses arising out of your violation of these terms or of any law in connection with your purchase or use of our products or website.
18. Governing Law
These terms are governed by the laws of the State of Tennessee, without regard to conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Montgomery County, Tennessee, and you consent to their jurisdiction.
19. Changes to These Terms
We may update these Terms of Service from time to time. Changes take effect when posted, and we will revise the effective date at the top of this page. Your continued use of the site or placement of an order after a change means you accept the updated terms.
